Papa John’s Sued for Failure to Deliver Fair Wages to Workers

Pizza delivery workers recently filed a class action lawsuit against Papa John’s International, Inc. and a number of its franchises, alleging that the company paid drivers less than the legally required minimum wage for all hours worked. 

papa johnsAccording to the complaint filed in the Southern District of Ohio, Papa John’s workers are either paid the “tipped minimum wage” of $2.13 an hour under federal law or the federal minimum wage of $7.25 per hour, since the company and its franchises operate under the assumption that the drivers who were given the tipped minimum wage would earn a minimum of $7.25 an hour, once tips and the $1.25 per delivery charge were added.

However, the plaintiffs charge that Papa John’s fails to fully reimburse drivers for their expenses and also requires them to pay for their own uniforms and insurance, dropping their compensation to approximately $4.50 an hour, well below Ohio’s minimum of $8.15 per hour or the federal minimum wage. The lawsuit also alleges that Papa John’s delivery drivers are required to maintain and pay for operable, safe, and legally compliant automobiles and in 2016, began to be responsible for tracking their mileage, although they were never reimbursed by the company for those miles.

The defendants in the lawsuit own and operate 27 Papa John’s Pizza restaurants in the Dayton and Cincinnati, Ohio area, part of a total of 73 such establishments they own throughout Ohio, Nevada, and North Carolina.

Other Papa John’s FLSA Lawsuits

Papa John’s is no stranger to this type of lawsuit. The pizza chain agreed to pay $500,000 in back wages and other damages to more than 200 New York employees in August 2016. It was the eighth time to date that New York Attorney General Eric Schneiderman caught Papa John’s violating wage and hour laws.
