(SANDUSKY, Ohio) - On November 29, 2012, Federal Chief Judge Solomon Oliver, Jr. certified a class action lawsuit filed by Dennis E. Murray, Sr. and Murray & Murray Co., L.P.A., on behalf of class of consumers who were victims of the unlawful debt collection practices of Midland Credit Management. This instant victory was the product of 7 ½ years of hard-fought litigation by Murray & Murray. The case was originally filed in 2005 in state court in Erie County, Ohio, and subsequently removed to federal court before Judge Oliver.
In 2006, Judge Oliver concluded that Midland Credit violated federal law by sending debt collection letters to certain individuals without informing those individuals of their right to dispute the validity of the alleged debt. However, Midland denied that its computer database contained enough information to identify those individuals whose rights were violated. Murray & Murray undertook extensive investigations of Midland’s computers and determined that there was, in fact, enough information in the database to identify the victims. Midland disputed this conclusion, but Judge Oliver ultimately agreed with Murray & Murray that the appropriate individuals can be identified and concluded that the case must proceed as a class action on behalf of an entire class, presently estimated to consist of more than 1,000,000 victims of the violation of federal laws.
The case is currently pending in the United States District Court, Northern District of Ohio, Eastern Division, and is entitled Zloro Johnson v. Midland Credit Management, Incorporated, Case No. 1:05 CV 1094.
