Murray & Murray Files Lawsuit against Ab Circle Pro Distributors

June 26, 2012

When you purchase a product, you expect that it will work properly and safely. However, mistakes in manufacturing and design do occur and a product may malfunction or break causing injury to you or others. Murray & Murray Co., L.P.A. fights for those who have been injured as a result of a defective product.

Recently, a federal judge permitted a lawsuit to proceed against distributors of a piece of defective exercise equipment - the Ab Circle Pro - which contains a defect that causes people to be thrown off the product at a high rate of speed. Murray & Murray Co., L.P.A. filed the lawsuit against the distributors of the Ab Circle Pro and defeated the distributors' argument that they were not subject to the Ohio federal court's jurisdiction. The federal judge concluded that because the distributors profited by selling the product to Ohioans, it was reasonable and fair for the court to exercise jurisdiction over them. The case is entitled Roshong v. Fitness Brands, Inc., Case No. 3:10cv2656, and is currently pending in the United States District Court for the Northern District of Ohio, Western Division, in Toledo, Ohio.
